TERMS OF SERVICE

Submission of a PO or Job to Screenplay represents a contract between Screenplay and its Customers. By placing an order with Screenplay, the customer agrees to compensate Screenplay for any work completed and originally approved by proof or sample. Compensation will be determined by the work completed and the terms outlined in this price sheet.

Screenplay reserves the right to review all art and textiles prior to final acceptance of a job and adjust the loss factor as well as price per piece accordingly. Prices subject to change at any time. Film, screens, molds, separations, digitized embroidery files, templates, production files, mockups, and all internal production assets created by Screenplay remain the proprietary property of Screenplay unless otherwise agreed in writing.

2% LOSS FACTOR OR DUFF ALLOWANCE

Due to the nature of custom production, slight overruns or underruns may occur and shall be considered acceptable industry standard. Screenplay reserves a 2% loss factor (also known as a duff allowance) on each decoration location. Screenplay reserves a 5% loss factor per location on specialty decorations due to complexity.  

WHAT IS A DUFF:

A Duff is when product gets ruined in the process of being decorated. Screenplay does not want anything to go wrong, and we have many QC checkpoints in place; however, duffs may happen occasionally simply due to being a custom production shop.

Screenplay is a contract only decorator, and our margins are small as we do not have any markup in the apparel. This 2% duff allowance is needed to keep decorating prices low.

HOW IT WORKS:

If, for example, you have an order of 100 shirts getting a back print and a front print, Screenplay reserves the 2% loss factor for both locations. In this example, 4 shirts could be ‘duffed’ due to having a 2% loss factor for the front print and 2% loss factor for the back print, so 4 shirts total.

Screenplay will replace product & printing for anything above 2% at no cost to the customer. However, anything below 2%, the customer is responsible for replacing the product (if desired). Screenplay will decorate the replacements at the same quantity pricing as the original order.

The maximum liability for replacement of any garment is limited to $100 per item unless physical samples are requested and approved in advance.

JOB SCHEDULING

Prior to scheduled print dates, Screenplay has a three-day schedule freeze. This allows our team to work three days in advance of print dates with burning artwork on screens, receiving inventory, and more. This improves the quality of work and allows us to automate the printing schedule for more accurate turnaround times.

Artwork should be submitted to Screenplay at the time the job is entered into the system. Jobs without artwork do not have a saved spot on the schedule and will not be scheduled until the artwork is received.

Product must be checked in at Screenplay at least three days before the print date to avoid jobs being rescheduled. Any jobs without product will be automatically rescheduled to the next available print date. Screenplay is not responsible for delays caused by third-party suppliers, manufacturers, freight carriers, or inventory shortages outside Screenplay’s control.

Screenplay makes good-faith efforts to follow estimated production schedules; however, custom production schedules may move forward or backward depending on production levels, product readiness, artwork status, approvals, quality-control concerns, and other operational factors. If you have an event or a hard deadline, please communicate that to your Account Manager, otherwise please build in a buffer of a few days to avoid any frustration. All turnaround times, production dates, completion dates, and estimated ship dates are estimates only and are not guaranteed unless expressly confirmed in writing by Screenplay management.

Customer acknowledges that production scheduling in the custom apparel industry is inherently variable and subject to operational, supplier, artwork, inventory, shipping, and quality-control factors that may affect estimated timelines before or during production.

TARGET COMPLETION DATES AND PRODUCTION ESTIMATES

Any Target Completion Date, requested deadline, production date, turnaround estimate, or estimated ship date is an estimated target only and is not a guaranteed completion date, delivery date, or contractual deadline.

Screenplay makes good-faith efforts to meet requested timelines; however, custom production involves many variables that may affect scheduling, including but not limited to artwork issues, proof revisions, delayed approvals, missing or incorrect product, supplier delays, shipping delays, inventory shortages, garment defects, dye migration, printing or embroidery complications, equipment issues, quality-control concerns, staffing constraints, and other production-related challenges.

Customer understands that delays may occur even after a job has been scheduled or proof-approved. Screenplay is not responsible for missed events, missed in-hands dates, lost sales, customer penalties, chargebacks, or other damages resulting from production delays, scheduling changes, carrier delays, or other timing-related issues.

Customers with firm events, retail launches, trade shows, or other time-sensitive deadlines are responsible for communicating those deadlines before submitting the job and building in an appropriate production and shipping buffer. Screenplay recommends allowing additional buffer time beyond the stated turnaround estimate whenever a deadline is important.

No deadline, rush date, event date, Target Completion Date, or requested completion date shall be considered guaranteed unless expressly approved in writing by Screenplay management.

PAYMENTS

Any invoice revisions must be requested within thirty calendar days of the completed job. There will not be any invoice revisions, replacements, or credits permitted after 30 days.

Any balance not paid within the stated terms of the invoices will be subject to interest at the rate of two percent (2%) per month (24% per annum) until paid.

RETURN POLICY

📄 Screenplay Return Policy

At Screenplay, we take pride in delivering high-quality custom decoration work. Due to the nature of contract printing and the custom products we produce, all sales are final. However, in the rare event that your order does not match the approved proof, we are committed to working with you to resolve the issue quickly and fairly.

🚫 All Sales Final

Once a job has been submitted and approved by proof or sample, it is considered final. Returns or exchanges are not accepted except in cases where the delivered product does not match the approved proof.

PROOF APPROVAL ... CUSTOMER VERIFICATION

All artwork proofs provided by Screenplay represent the final digital representation of the finished decorated product. Proofs are provided so the customer can verify every detail prior to production. By approving a proof, the customer confirms that all details shown are correct and approved, including but not limited to artwork, spelling, placement, sizing, colors (including Pantone values when applicable), garment selection, quantities, and any special instructions. Customer is responsible for verifying all Pantone selections, color callouts, and approval details prior to production.

The approved proof is the sole and controlling reference for production. Screenplay’s production team decorates exactly what is shown on the approved proof... nothing more and nothing less. Any prior or subsequent emails, phone conversations, text messages, notes, or other communications are intended only to assist in creating an accurate proof and do not override or modify the approved proof.

These Terms of Service, together with any approved proofs, invoices, and written order confirmations, constitute the entire agreement between the parties and supersede any prior verbal or written communications, representations, or understandings relating to the order.

No verbal statements, discussions, or representations by any Screenplay employee, representative, or agent shall modify or override these Terms unless confirmed in writing by Screenplay management.

Because proof creation is a human process, a proof may occasionally contain errors or omissions (including items previously communicated by email or phone). It is the customer’s responsibility to identify and request corrections prior to approval. If a proof is inaccurate, incomplete, or does not match the customer’s expectations for any reason, do not approve the proof and request a revision. If a customer approves a proof that contains an error or omission, Screenplay is not responsible for the resulting outcome.

Please note that digital mockups may not be perfectly to scale or match the color on  a computer screen. Customers should reference the specific size measurements, placement notes, and color callouts shown on the proof and review carefully (zoom in, check spelling, sizing, and locations) before approving. Approve the proof = approve the outcome.

Due to variations in garments, fabrics, dye lots, thread manufacturing, specialty inks, monitor displays, embroidery materials, heat application, and production processes, exact color matching and placement consistency are not guaranteed.

Production timelines are estimates only and are not guaranteed. Please allow appropriate production and shipping buffer time for all event-related or deadline-sensitive orders.

🔍 Order Issues and Defects

Customer is responsible for inspecting all goods immediately upon receipt. Any concerns regarding shortages, defects, damage, or order discrepancies must be reported promptly and no later than thirty (30) days after delivery.

We stand by our work. If you believe your order is incorrect or defective, please contact your Account Manager immediately. If Screenplay determines, in its sole discretion, that an order issue qualifies for resolution under these Terms, Screenplay reserves the exclusive right to determine the appropriate remedy, if any, including repair, reprint, replacement, account credit, or refund.

To be eligible for any resolution:

  • You must notify your Account Manager within 30 days of the completed job.
  • The original product must be returned to Screenplay for inspection before any credit, reprint, or refund is issued.
  • Requests made after 30 days from completion will not be considered.

Please note: Orders that match the approved proof are not eligible for reprint, refund, or credit.

💳 Refunds and Credits

If a refund or credit is approved as part of a resolution:

  • The refund will be issued to your original payment method.
  • Refunds are processed within 10 business days of the returned goods being received and inspected.
  • If more than 15 business days have passed and you have not received confirmation, please contact us at info@screenplayshirts.com.
  • The maximum liability for replacement of any garment is limited to $100 per item unless physical samples are requested and approved in advance.

SHIPPING & RECEIVING

Jobs that require unpackaging (individually polybagged) before we can run the job, will be charged the unpackaging fee listed on the shipping/receiving page of this price sheet.

We blind ship using our customer’s shipping account number.

  • Handling charge for UPS or FedEx ground shipping is $2.00/Box.
  • Handling Charge for FedEx Express is $5/Box. (Charges still apply if emailed shipping labels are provided.)
  • $20.00 per pallet when shipping LTL. (Please email the Bill of Lading to your account manager.)

Screenplay shall not be held responsible for product left for more than 60 days.

LIMITATION OF LIABILITY

Screenplay’s liability for any claim arising out of or related to any order, decoration service, shipment, delay, defect, or other issue shall be strictly limited to the amount paid to Screenplay for the specific decoration services performed on the affected items.

Under no circumstances shall Screenplay be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to lost profits, lost sales, missed deadlines, business interruption, retail chargebacks, customer penalties, reputational harm, or event-related losses, even if advised of the possibility of such damages.

Except as expressly stated in these Terms, Screenplay disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, wash durability, color matching, or suitability for any specific use or application.

FORCE MAJEURE

Screenplay shall not be held responsible for delays, interruptions, or failure to perform caused by circumstances beyond its reasonable control, including but not limited to weather events, natural disasters, labor shortages, supply chain interruptions, carrier delays, equipment failure, utility outages, government actions, acts of God, pandemics, or other unforeseen events.

SHIPPING LIABILITY

Once product has been transferred to a shipping carrier, all risk of loss, damage, or delay passes to the customer. Screenplay is not responsible for carrier delays, lost shipments, damaged shipments, incorrect delivery by the carrier, or shipping interruptions once packages leave our facility.

Customers are responsible for verifying shipping addresses, carrier account information, and delivery timelines prior to shipment.

CUSTOMER-SUPPLIED GOODS

Screenplay is not responsible for defects, inconsistencies, dye migration, shrinkage, heat sensitivity, manufacturing flaws, or performance issues related to customer-supplied garments or products.

Due to the custom nature of decoration and the varying manufacturing processes used by apparel vendors, Screenplay cannot guarantee results on customer-supplied goods.

INTELLECTUAL PROPERTY / CUSTOMER ARTWORK

By submitting artwork, logos, trademarks, designs, or other content to Screenplay, the customer represents and warrants that they have all necessary rights, licenses, and permissions to reproduce and decorate such materials.

Customer agrees to indemnify, defend, and hold harmless Screenplay from and against any claims, damages, liabilities, costs, or expenses arising out of or related to alleged copyright infringement, trademark infringement, licensing disputes, or unauthorized use of submitted artwork or intellectual property.

COLLECTION COSTS

Customer agrees to pay all collection costs, court costs, attorney fees, and related expenses incurred by Screenplay in collecting unpaid balances or enforcing these Terms of Service.

NO WAIVER

Failure by Screenplay to enforce any provision of these Terms of Service shall not constitute a waiver of future enforcement of that or any other provision.

SEVERABILITY

If any provision of these Terms of Service is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

GOVERNING LAW AND VENUE

These Terms of Service shall be governed by and interpreted under the laws of the State of Utah.

Any dispute arising out of or relating to these Terms, any order, or services provided by Screenplay shall be resolved exclusively in the state or federal courts located in Utah County, Utah, and the customer consents to such jurisdiction and venue.

PRICING

All quoted pricing is subject to change prior to final order approval and production scheduling. Once a job has been approved and scheduled, pricing will not change unless the scope of work, quantities, garment selection, decoration method, freight costs, or requested services change.

REMEDIES

If Screenplay determines, in its sole discretion, that an order issue qualifies for resolution under these Terms, Screenplay reserves the exclusive right to determine the appropriate remedy, if any, including repair, reprint, replacement, account credit, or refund.
